PENNSYLVANIA LABOR RELATIONS ACT - ORGANIZING
WHEREAS, The Pennsylvania Labor Relations Act (PLRA) process of union certification is cumbersome and tilted against union organizing; and
The PLRA provides that unions can only have access to the list of potential voters in a union certification election until a few weeks before an election; and
The PLRA allows for employer obstruction through legal proceedings of a collective bargaining election; and
Prompt union elections are vital to allow workers real choice; and
The lengthy and litigious procedures of the PLRA deny workers a real chance to join a union; and
Canada allows for a majority “card check” recognition of the union; and under current Pennsylvania Law the obligation to bargain is only to act in “good faith;” and
Canada provides that the first contract be achieved through mandatory arbitration.
THEREFORE, BE IT RESOLVED, That the Pennsylvania AFL-CIO support legislation to adopt the Canadian System including “card check” recognition and first contract mandatory arbitrations.
