Resolution No. 22

OVERTIME

 WHEREAS, Fifty years ago, as part of the Roosevelt New Deal, the Fair Labor Standards Act was adopted; and

The Fair Labor Standards Act addressed, among other issues, hours of work and overtime pay requirements; and

The Department of Labor clearly defined the requirement of the 40 hour work week and requiring time and one half pay for all non-supervisory workers; and

The Bush Administration has adopted, over strong objection, a new definition of supervisory roles to virtually classify any worker with some degree of responsibility for fellow workers as supervisors or independent supervisors; and

The Bush Administration’s overturning over 50 years of Administrative Law, has made millions of hourly workers exempt from the forty hour work week and the payment requirement of time and one half for work over 40 hours per week.

THEREFORE, BE IT RESOLVED, That the Pennsylvania AFL-CIO, along with the National AFL-CIO and our affiliates, support legislative or administrative action to reverse the Bush Administration’s new interpretation of overtime and the workers covered as originally intended by the Fair Labor Standards Act.
