Resolution No. 51

SUPPORT OF IMPOSITION OF FINES AND PENALTIES ON UNFAIR UNION-BUSTING EMPLOYERS

WHEREAS, According to recent studies, it has been discovered that over 60 million non-union, private-sector workers want to be part of a Union workplace, and would vote to be represented by a Union; and

According to those same studies the only reason that the same group of workers do not immediately attempt to join Unions is because they are afraid of being fired; and

Those fears arise because so many employers fire workers, intimidate workers, threaten to close workplaces and engage in many other improper and illegal acts while union-busting during Union Organizing Campaigns; and

That even in the small percentage of cases where employers are found guilty of violating workers' rights, they face insufficient sanctions to dissuade them or any others from continuing their illegal behavior; and

That in order to stop these types of improper and illegal actions, and therefore protect the rights of workers to organize, the employers must face real and substantial penalties when they break the law.

THEREFORE, BE IT RESOLVED, That the Pennsylvania AFL-CIO, and it’s affiliates, support the effort to work together with the National AFL-CIO, and all other Labor Unions, to have laws, rules, regulations and executive or administrative orders enacted that will impose significant monetary fines and real penalties on any and all employers who violate workers' rights to organize through firings, threats and any and all other forms of intimidation.
